Welcome to Retro Road! The terms "we", "us" and "our" refer to Retro Road, operated by Retro Road operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Retro Road is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with our Refund, Return & Warranty Policy, Shipping Policy and Privacy Policy (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. They include important information about your legal rights, including warranty terms and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.

Nothing in these Terms limits or excludes any rights you have as a consumer under applicable law that cannot be limited or excluded by contract.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province or country of residence, and that you have given consent for any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including browsing our store or purchasing products, you may be asked to provide certain information, such as your email address and billing, payment and shipping information. You represent and warrant that all information you provide is correct, current and complete, and that you have all rights necessary to provide it.

You are responsible for maintaining the security of your account credentials and for activity on your account. You may not transfer, sell, assign or license your account to any other person.

SECTION 2 - OUR PRODUCTS

We make every effort to accurately represent our products. However, colors and product appearance may differ slightly from how they appear on your screen depending on your device and its settings.

All product descriptions are subject to change at any time without notice. We may discontinue any product at any time and may limit the quantities of any product offered to any person, region or jurisdiction.

Products sold by Retro Road are covered by our 90-Day Limited Warranty against defects in materials and workmanship, as described in our Refund, Return & Warranty Policy .

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. Your order is accepted when we send you an order confirmation email. We may decline an order before acceptance, for example due to product unavailability, pricing errors or suspected fraud. If we decline or cancel an order after you have been charged, we will notify you and issue a full refund to your original payment method.

Please review your order carefully before submitting it. Cancellation requests can be made by emailing retroroadinfo@gmail.com; we will accommodate them if the order has not yet shipped. Once shipped, the order may be returned under our Refund, Return & Warranty Policy . If you are a consumer in the EU, EEA or UK, you also have the 14-day right of withdrawal described in that policy.

You represent that your purchases are for personal or household use and not for commercial resale.

SECTION 4 - PRICES, TAXES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect when your order is placed, as shown in your order confirmation email. Changes will not affect orders already accepted.

The total price, including any shipping charges and applicable taxes, is shown at checkout before you complete your purchase. We do not charge hidden or undisclosed fees.

Customs, duties and import charges: All import duties, customs fees and taxes for orders shipped to the United States are included in the price shown at checkout. You will not be charged anything on delivery..

Promotions may be governed by separate terms. If a promotion's terms conflict with these Terms, the promotion's terms govern for that promotion.

You agree to provide current, complete and accurate payment and account information and to update it promptly as needed. You represent that you are authorized to use the payment method you provide and that you will pay all charges at the prices in effect when incurred, including shipping and applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY

Estimated shipping and delivery times are shown on our Shipping Policy [LINK] and at checkout. We make every reasonable effort to ship orders within the stated time.

If we are unable to ship your order within the stated time (or within 30 days of your order if no time was stated), we will notify you and give you the option to cancel your order for a full refund or to agree to a revised shipping date. If you choose to cancel, your refund will be issued within 7 business days.

Delivery times after shipment depend on the carrier and customs processing and are estimates. If your package is lost in transit or arrives damaged, please contact us at retroroadinfo@gmail.com and we will replace the item or issue a refund, as described in our Refund, Return & Warranty Policy [LINK].

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement thereof, are owned by Retro Road, its affiliates or licensors and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any material on the Services without our prior written consent, except as permitted by law. Nothing in these Terms grants you any license or right under any patent, trademark, copyright or other intellectual property of Retro Road, Shopify or any third party. All rights not expressly granted are reserved.

Retro Road's names, logos, product and service names, designs and slogans are trademarks of Retro Road or its affiliates or licensors and may not be used without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos and marks on the Services are the property of their respective owners.

SECTION 7 - OPTIONAL TOOLS

We may provide access to third-party tools that we do not monitor or control. Such tools are provided "as is" and "as available", without warranties or endorsement of any kind. Your use of them is at your own risk, and you should review the terms on which they are provided by the relevant third party.

New features or tools we add to the Services in the future will also be subject to these Terms.

The Services may contain links to websites or content operated by third parties. We are not responsible for the content or accuracy of third-party websites, or for any products, services or content you obtain from them. SECTION 9 - RELATIONSHIP WITH SHOPIFY

Retro Road is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Retro Road. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Retro Road, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Retro Road.

SECTION 10 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy and certain personal information may be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit will be shared with Shopify and with third parties that may be located in countries other than where you reside, in order to provide the Services to you. If you submit ideas, suggestions, feedback, reviews or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display that Feedback in any medium for the purpose of operating, improving and promoting the Services. You represent that you own or have the necessary rights to your Feedback, that you have disclosed any compensation or incentive you received in connection with it, and that it reflects your honest experience. We are not obligated to keep Feedback confidential, pay for it, or respond to it.

We may remove Feedback that is unlawful, offensive, threatening, defamatory, obscene, contains personal information, is unrelated to the product, is spam, or infringes the rights of others. We apply these criteria equally to all reviews and do not remove or suppress reviews because they are negative.

You agree that your Feedback will not violate the rights of any third party, contain malware, or misrepresent your identity. You are responsible for the Feedback you submit.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct such errors and to update information at any time. If an error affects an order you have already placed, we will contact you and give you the option to proceed with the corrected details or cancel for a full refund.

In addition, you agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, copy, extract, resell or exploit any portion of the Services without our permission; (c) collect or track the personal information of others; (d) phish, pharm or pretext the Services; (e) use any robot, spider, scraper, data-extraction tool, automated process or AI tool (including agentic AI) to access the Services except as permitted in Section 14; or (f) bypass or circumvent security features, robot exclusion headers or other access restrictions. We may suspend or terminate your account if we reasonably determine that you have violated these Terms.

SECTION 14 - AGENTS

14.1 This section ("Agent Terms") applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity without direct supervision.

14.2 No Agent may access, use or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with Section 14.4. No Agent may access the Services if we have requested that it refrain from doing so.

14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the Agent's name by including "Agent/[agent name]" in the user agent string; (ii) not conceal or obfuscate that any access, use or interaction is from an Agent, including by mimicking human behavior or completing or circumventing CAPTCHAs; (iii) respond truthfully to any question seeking to determine whether interactions come from a human or a computer; and (iv) not circumvent any measure intended to block, limit or control Agent access.

SECTION 15 - TERMINATION

We may terminate these Terms or your access to the Services at any time. Termination does not affect orders already accepted, your rights under our Refund, Return & Warranty Policy, or any amounts owed up to the date of termination.

The following sections survive termination: Intellectual Property, Reviews and Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.

SECTION 16 - DISCLAIMER OF WARRANTIES

Products. Products sold by Retro Road are covered by our 90-Day Limited Warranty, described in our Refund, Return & Warranty Policy [LINK]. Any implied warranties on products, including the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the 90-day warranty period. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. If you are a consumer in the EU, EEA or UK, the Limited Warranty is in addition to your statutory rights, including the legal guarantee of conformity, which are not affected.

Website and information. The website and information presented through the Services are provided for general information purposes on an "as is" and "as available" basis. To the extent permitted by law, we do not warrant that the website will be uninterrupted, timely, secure or error-free, or that information on it is complete or accurate.

SECTION 17 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, RETRO ROAD, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PRODUCT OR ORDER SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT OR ORDER.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

SECTION 18 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Retro Road, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party arising out of (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, or (3) your misuse of the Services.

We will notify you of any indemnifiable claim, though a failure to notify promptly will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such a claim at your expense, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims.

SECTION 19 - SEVERABILITY

If any provision of these Terms is found to be unlawful, void or unenforceable, it shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be severed without affecting the validity of the remaining provisions.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms and the policies referenced in them constitute the entire agreement between you and us regarding the Services and supersede any prior agreements or versions of these Terms.

SECTION 21 - ASSIGNMENT

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms, provided that doing so does not reduce your rights under them.

SECTION 22 - GOVERNING LAW AND DISPUTES

Option A (company based in Spain): These Terms are governed by the laws of the United States, without regard to its conflict-of-law rules. If you are a consumer, you also benefit from any mandatory consumer-protection provisions of the law of the state or country where you reside, and nothing in these Terms limits your right to bring a claim in small claims court or in the courts of your place of residence where applicable law allows."

We will notify you of material changes as required by applicable law, and changes take effect on the date stated. Changes do not apply to orders placed before the change takes effect. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
